Minister: Salary reduction in non-affected sectors invalid

Any salary reduction agreement between the employer and the employee in sectors not deemed “most affected” by the coronavirus crisis is null and void, Minister of Labor Nidal Bataineh said on Tuesday, citing Communiqué No. 8 issued under Defense Order No. 6.

The minister further explained that such agreements remain invalid even if the employee was reporting to the employer’s premises or was telecommuting or not required to do any work.

Bataineh said these sectors, which are not considered hard hit by the crisis, reopened and there are no justifications for any pay deductions from the employee.

He indicated that the ministry had received many complaints in which the worker was given the choice to resign or sign such an agreement, saying: “This is not the free will we have been talking about.” The minister emphasized that there are many employers who have embraced their workers and opted not to deduct any part of their wages, even though the defense order allows them to do so.

Under Communiqué No. 8, the minister explained, employers in most affected sectors are allowed to agree with their employees to deduct salaries by a maximum of 20 percent for those who report to work and 50 percent for those who do not do any work, provided that the wage, after the reduction, should not fall below the statuary minimum wage.
